william lynn could be released from prison today. but prosecutors are eyeing up another trial. strip mall firefight. crews battle for hours. and a busted water main still causing problems this morning. nbc 10 news starts now. 6:00 a.m., 73 degrees outside. good morning, this is "nbc 10 news today." i'm tracy davidson. >> i'm katy zachry. thanks for joining us. if you stepped outside, you'll notice relief is in the air. we'll check in with meteorologist bill henley to see if that's going to stick around for today orç the rest of the week. >> temperatures are running cooler than yesterday. 73 degrees in philadelphia. in the suburbs, 69 degrees right now, into the 70s with mostly cloudy skies for the suburbs and for the lehigh valley where clouds are lingering. there will be some sunshine later this morning. look at the temperature warming up to near 80 degrees at lunch time in the lehigh valley. delaware, a chance of a shower

this afternoon. just a slight chance of a shower. most of the day it will be dry. with some breaks of sunshine into the 70s, topping out near 80 degrees this yafternoon, 81 for philadelphia, suburbs 80 with partly sunny skies. there's a chance for an isolated shower or possibly a thunderstorm. most of the day will be dry. you'll see more sunshine this afternoon than we'll be seeing this morning. a lack of sunshine will likely help with the commute, some of that bright sunshine can slow things down. let's find out how the traffic is moving this morning. jessica boyington has your first alert update. >> we have an update on a few things we just found in our cameras a few moments ago. 95 around cottman avenue, just a few minutes ago, literally five minutes ago, we had an accident scene. headed southbound into center city, now that has just cleared out of the way. we have big delays into center city. 95 around cottman avenue. here's the 42 freeway around creek road over in runnemede.

we just had a traffic stop over here with police officers involved over into the right-hand shoulder. that's clear as well. northbound into philadelphia, no big problems there. but there is a disabled vehicle that's reported out in abington on old york road and bader road. more updates on the rest of your morning drive. police are looking for the driver in a deadly hit and run in atlantic county. they say an suv hit and killed a woman while she was crossing the white horse pike in galloway township last night at 6th avenue. witnesses told police the suv ran a red light, hit the woman and then took off. they are looking for an older model chevy tahoe or suburban. monsignor william lynn could walk out of prison after serving three years. matt delucia is outside the criminal justice center in south philadelphia. >> monsignor william lynn's attorneys are asking the judge for a release, all the while,

prosecutors are trying to decide whether or not to retry the official. the pennsylvania supreme court last month upheld a superior court ruling that lynn deserves a new trial. prosecutors argued that monsignor william lynn knowingly transferred pedophile priests from one parish to another here in the philadelphia archdiocese during his send ytenure as secr of clergy, the early '90s through 2004. he's served three years of a six-year sentence at a prison in northeastern pennsylvania. an attorney says lynn should be released because as of now, with an overturned conviction he's not being held on formal charges. he would like lynn released on 10% of $250,000 bail. monsignor william lynn is 65 years old. in the coming days or even today he could be released by that judge if that order is granted here.

live at the criminal justice center, matt delucia, nbc 10 news. three firefighters are recovering from heat exhaustion after battling aç building fir in doylestown. skyforce 10 was over the scene of thick smoke that rose above gsi kitchen and bath show place last night. it took 150 firefighters several hours to get the fire under control. they got help from backup water tankers when they began to lose water pressure. they battled the intense heat and flames. >> because it was so deep seeded, mostly we just saw smoke and heat. every once in a while when it found a place to break through, either the roof or the front, some fire would break out. >> the fire marshal is trying to determine what caused the fire. now to a story from delaware county we brought you as breaks news last night. you can see the hole opened up as workers tried to get to the broken main. the intersection is expected to re-open by 8:00 this morning,

just in time for the commute. >> five minutes past 6:00. new jersey attorney general and office is investigating the shooting of a new jersey man by state troopers in his home. officials say troopers mistakenly responded to a home of 76-year-old gerald sykes after a dropped 911 call late last friday. the call did not come from the sykes home in upper deerfield township. sykes grabbed his shotgun when he heard people outside. he was in his living room when he was shot three times in the back. he claims the troopers did not announce themselves. state police say they did announce themselves. sykes remains hospitalized at cooper medical center. the city of philadelphia is trying to decrease accidental shootings by giving away gun locks. this is in response to a new law in philadelphia that requires guns to be locked when not in use. officials will be at rose play ground at 75th and lansdowne avenue tonight from 6:00 to 8:30. tomorrow it's at 32nd and cumberland.

new details on the kathleen kane perjury trial. jury selection is set to begin tomorrow. lawyers for the pennsylvania attorney general asked the state supreme court to throw out charges against her. kane argues that the grand jury that investigated her was unlawful, claiming the special prosecute who ran the panel had no authority to do so. she's accused of leaking secret grand jury material and lying about it under oath. now your nbc 10 first alert weather. >> six minutes after 6:00. we're looking at cloudy skies this morning but no sign of showers this morning if you're heading out, it's muggy and cloudy. there's plenty of moisture in the area. some areas seeing a little bit of fog, not happening in center city. you don't even have the low clouds we had yesterday. sun breaks through as the day goes on. though there's still a slight chance of a shower, possibly even a thunderstorm during the day today. mostly it's going to be dry and it's going to make for a nice partly cloudy evening. clouds will break, the humidity will be coming down this

evening. right now, look at hazleton, zero visibility. light fog in lancaster and mt. pocono. it's not an issue at all in philadelphia, new jersey or delaware. but clouds are lingering in these locations. got some breaks in the clouds at the shore. that's where we're seeing sunshine. still a few clouds in the area, 71 degrees at the shore. low 70s for most of the rest of the area and in the suburbs this morning, 67 now in west kallen township and warrenton is 69 degrees. not going to be a hot day today. it is going to be another day with a chance of a shower. for now, any shower activity is way to the north and offshore. we'll watch for some spotty showers at best. most of theç day, dry. with clouds breaking for some sunshine into the low 80s for center city and somerton, doylestown, 75 degrees. clouds lingering. we'll see sunshine break through later in the day after a cloudy morning. and the lehigh valley, upper 70s and low 80s with a chance of a

shower. spotty showers, isolated shower possible in new jersey and at the shore. wilmington, drying out this morning but a possibility we'll see an afternoon shower. by this evening, we'll really be drying out as the humidity comes down. got your t10 day on 10 when i'm back in a few minutes. there have been a few bumps in the road with traffic. >> we're watching cottman avenue right now. again, for some big delays. we had an earlier accident scene that's cleared out of the way for right now. you can see we are still see something of that delay. 23 minutes already in the yellow. this time yesterday, we didn't see any delays on 95 all morning, especially. southbound from woodhaven road to the vine street expressway. that's where we're seeing the delays and speeds that are dropping down into the 30s. also moving over into new jersey, watching burlington township, a downed pole closing a portion of route 206 around pemberton road.

6:13. good morning, valley forge. we're at 70 degrees. meteorologist bill henley is tracking conditions in our neighborhood. we'll be back in just minutes with the first alert forecast. an engineering firm and its project manager is denying they ripped off hurricane sandy victims. >> the case covers home owners in our area in new jersey as well as in new york. yesterday, authorities released the manager on bail after he and the firm pleaded not guilty to charges of felony fraud and operating without a license. insurance companies hired the firm to evaluate damage from the 2012 superstorm. but scores of home owners filed lawsuits claiming engineering reports illegally altered by the firm cheated them out of insurance money they should have gotten. >> he's completely innocent. he did not defraud anybody. >> the insurance company is scamming the home owners. so, you know, they should be penalized. >> smaller insurance payouts for some sandy victims to delay rebuilding their homes or they had to walk away from their

over the coming days, we will see drying conditions. the rain chances will be decreasing for allentown, atlantic city, philadelphia and dover. until we get to saturday, that's when the chance of rain goes right back up. and we're also getting a break from the heat, too. not so hot. today the temperatures will be lower and the next few days will be below normal temperatures by the end of the week, though, philadelphia is back into the upper 80s, middle 80s for allentown, it stays cooler at the shore as one would expect. dover will warm into the lower to middle 80s by friday. but a nice break from the extreme heat we saw from most of the next week. sunshine today will break through some spots of sunshine this afternoon. the 10 day on 10 has clearing skies for tomorrow and cooler, too, in the morning, an indication of less humid conditions. the humidity will be down tomorrow by thursday, the temperature up just a little bit. the humidity will still be in check on thursday. by friday and the weekend,

sunshine will fade saturday with a chance of some showers and thunderstorms as the temperatures reach into the low 90s on saturday. then back into the 80s with sunny skies for sunday, becoming more comfortable, moving into monday, the humidity drops once again, later sunday and monday. sunshine with temperatures in the 80s for tuesday and wednesday, back up to 90, though, thursday. >> bill, thanks.ç 6:18. let's get you to work on this tuesday morning. >> jessica boyington is here with a check of the roads. >> what are you watching it seems like? there may be no issues behind you where we have had issues the last few times we saw you. >> we are seeing more of a rush hour around this time over yesterday. we didn't have a rush hour yesterday. we're looking at new jersey, the jersey roads are doing great, 295 in mt. laurel around route 38. all lanes moving along nicely. more traffic headed southbound right now.

welcome back. it's a few minutes before 6:30. a new jersey veteran suffering from post traumatic stress disorder could soon be treated with medical marijuana. yesterday, the state senate passed a measure to allow the drug to be used for ptsd patients. the bill now heads to governor chris christie's desk for final approval. medical marijuana is already approved in new jersey for treatment of ms, terminal cancer and muscular dystrophy. tonight the questions of tolls for a replacement bridge on i-95 will be up for discussion at a public hearing. the scudder falls bridge spans the delaware river. construction of a new bridge is set to begin next year. tonight's hearing in easton will focus on new toll rates for the replace mts bridge. the delaware river joint toll bridge commission is proposing a $1.25 toll for passenger vehi e vehicles with e-z pass. the toll would be one way,

neighborhood forecast. bill, how does it look out there? >> we have sunshineç breaking through the clouds. you can see it in delaware, 71 degrees in frawley stadium, seeing that sunshine. the temperatures will climb into the upper 70s with partly sunny skies at 11:00. 77 degrees, heading into the low 80s this afternoon. clouds are lingering in the suburbs, not seeing the fog that we had yesterday but mostly cloudy skies at king of prussia, those clouds will linger into the early afternoon hours. we'll eventually see enough sunshine to see enough temperatures warm in the entire area into low 80s this afternoon. that's cooler than normal this time of year. there's still a chance of an isolated shower in the lehigh valley and in delaware. but most of the day we're looking at dry conditions, partly sunny skies this afternoon. i'll go through the forecast hour by hour. one forecast for each of our areas when i come back in just a few minutes. right now, let's see how the traffic is looking on a tuesday morning. jessica boyington has an update. >> we're watching for a disabled

tractor-trailer in northeast philadelphia on the boulevard, headed southbound in one of the lanes of the inner drive. that's where we're seeing that blocked off, approaching strahl e-street. we are seeing minor delays. the eastbound lanes, trooper road, having more traffic headed towards the schuylkill expressway. speeds clocking into averaging high 50s. from 29 to the schuylkill, we're okay with a nine-minute trip. upper dublin, jarretttown road and north linkilhn pike. in a just released positivele this morning, support is growing for democratic presidential nominee hillary clinton. the survey monkey poll shows clinton leading republican rival donald trump by eight points, 50% to 42%, a seven-point bounce for clinton following the democratic national convention in philadelphia. the same poll last week showed trump getting no bounce from the republican convention, though

other polls did show a bounce. meantime, donald trump and hillary clinton again took aim at each other on the campaign trail yesterday. >> that's right. donald trump let loose during a rally near harrisburg. the gop nominee was in pennsylvania, trying to appeal to working class voters in one of the top battle ground states in this election. trump had these choice words for clinton and her formal rival turned supporter bernie sanders. >> if he would have just not done anything, go home, go to sleep, relax, he would have been a hero but he made a deal with the devil. she's the devil. he made a deal with the devil. true. >> trump also said he's afraid the fall election will be, quote, rigged. >> yesterday hillary clinton was stumping in omaha, nebraska, joining billionaire warren buffett who endorsed her over the weekend. clinton was talking about her tax plan when she mentioned her opponent's name. >> i'm told donald trump stays glued to the tv set. i hope he heard warren.

while warren is standing up for a fairer tax code, trump wants to cut taxes for the super rich. >> today clinton will be in colorado while trump campaigns in virginia. meantime, trump is facing more criticism about how he is handling a back and forth with the family a fallen soldier. nbc 10's pamela osborne is live in the digital operations center. we're now hearing from both vice presidential candidates as well. tell us more. >> tracy, we are. it started with one gold star family calling out donald trump for a stance on immigration at the dnc. khan said trump's policies wouldn't have allowed th[ son to be an american. captain humayun khan was killed in iran fighting for the u.s. he was protecting his fellow soldiers from a suicide bomber at the time of his death. several other gold star families are joining in support of the khans who have gotten an earful from donald trump. last night, trump tweeted this,

quote, mr. khan, who did not know me, viciously attacked me from the stage of the dnc and is now all over tv doing the same. nice. here's what clinton's running mate, tim kaine, had to say about trump's ongoing feud with the gold star family. >> donald trump has the temerity to say we're going to punish muslims, we're not going to let them in the country. he paints a broad brush. this family and many muslims have lost their lives serving in the united states military during the last 15 years. many, many. >> trump's running mate mike pence also addressed trump's remarks to a crowd last night. >> as i said last night, as donald trump said saturday night, captain khan is an american hero and we honor him and honor his family as we do all old star families. >> donald trump fired off another tweet last night which read, quote, the story isn't

about mr. khan but rather, quote, radical islamic terrorism and the u.s. get smart. end quote. meantime, john mccain is one of the latest republicans speaking out about trump's remarks, saying captain khan is an example of true american greatness. reporting live in the digital operations center, pamela osborne, nbc 10 news. in the meantime, more republicans are stepping forward to denounce donald trump's comments about the muslim parents of a fallen u.s. soldier. that includes pennsylvania senator pat toomey who's fighting to be re-elected come november. yesterday, toomey said the khan family like all americans who lose loved ones in the defense of our country deserve our gratitude and honor. anything else is inappropriate. toomey's opponent katie mcginty says those words are not enough. she responded, until pat toomey pledges to oppose donald trump in november, his carefully crafted statements about our nation's veterans and armed forces are completely hollow.

a group of citizens wants to end illegal parking in the middle of broad street in south philadelphia. city officials enforced the ban during the democratic national convention but as of last night, things were back to normal with cars parked in the median. the political action committee, fifth square, wants to change that. the group's online petition showed at least 1,000 people asking the city to enforce the median parking ban to make streets safer for pedestrians. mayor jim kenney's office set a public dialogue has to be held before any change is made. the home owners we talked to did not want to see a change. >> you spend a good 20 minutes sometimes looking for parking down here. >> i think as long as people in south philly own cars, it's going to it be a real problem to get this passed. >> we did find one homeowner who said he signed the petition agreeing that median parking on south broad street is dangerous. 6:35. today the cleanup continues in a small maryland town after a deadly storm. heavy rain caused devastating flash flooding which led to more

than 100 water rescues and left two people dead. this is what it looks like now after the water receded in ellicott city, maryland. now take a look at what caused it. the severe weather that hit saturday night. six inches of rain fell in just two hours. overwhelming small streams, causing water to surge down main street. a group of 11 people formed a human chain to save a woman who was trapped in her car. a state of emergency has been declared in that area. one of the people killed, one of the two people killed in the flooding is from pennsylvania. 35-year-old jessica watsula from lebanon was visiting family and trying to drive away. she leaves behind a 10-year-old daughter. her car was swept away by flood waters. now your nbc 10 first alert weather. >> 6:36. mostly cloudy skies. the clouds, though, already showing signs of thinning out. this is easton, pennsylvania. you can see some sunlight making

it through. a view of the sun this morning from the comcast center. we can see sunshine and a few scattered clouds. the clouds will be thinning out as the day goes on. we're starting off in the low 70s, 73 degrees in philadelphia. by lunch time, partly sunny and 77, near 80 degrees this afternoon. the suburbs, clouds this morning will thin out this afternoon. there's a chance of an isolated shower. certainly not an all-day rainfall. the lehigh valley, 72 degrees now. clouds linger for much of the morning. we'll get some breaks of sunshine, a slight chance of an afternoon shower. into the upper 70s for new jersey. winds out of east at 8 miles an hour. those will be stronger at the shore, the jersey shore, will have afternoon temperatures a little bit warmer than they are right now. 74 degrees now. into the middle 70s. they'll be held back by stronger onshore breezes.sunny skies at . for delaware, we're seeing some breaks of sunshine.

now your nbc 10 first alert weather. >> 6:45. heading out right now. we have clouds that are breaking. it is a muggy morning. the mugginess will stay with us into the afternoon. but with breaks of sunshine, the sun really breaks through later this morning, this afternoon. the temperatures lime into the low 80s today. partly cloudy this evening as we'll be drying out. the humidity will be coming down during the evening hours. this morning it's the temperatures that have come down into the low 70s, 71 degrees in delaware. seeing sunshine in delaware and south jersey, while it's mostly cloudy in philadelphia and the suburbs. 68 degrees in west kallen township. upper 60s in western chester county. north wales is at 70 along with ft. washington. warrenton 69. pretty uniform temperatures. that's typical when you have lots of clouds overhead. satellite and radar, though, shows inç spite of lots of clouds, not much in the way of showers. the showers this morning are farther to the north and northeast. there is a slight chance of a shower this afternoon. our chances, though, for rain

over the next couple days will be coming down. a slight chance for allentown and atlantic city today. for philadelphia and dover, but look how it lowers over the next couple days as that drier air comes in and goes right back up as we go into the weekend on saturday. that's the next chance of rain. not so hot, normally we're in the 80s. middle to upper 80s this time of year. the next few days will be below normal. sunshine will warm into the low 80s for philadelphia today and tomorrow. a little bit cooler for tomorrow in dover. wildwood is seeing 70s for the next few days, allentown, low to mid-80s over the next several days. so not much in the way of rain, not much in the way of heat but we're certainly seeing plenty of clouds this morning. they'll break for some sunshine this afternoon for philadelphia, the suburbs and the lehigh valley. a shower is possible this afternoon, new jersey, even at the shore. most of the day will be dry, even in delaware, 80 degrees this afternoon.

street. just typical morning volume. we are watching 14-minute delays on thorndale train 1580 for septa. other than that, mass transit pretty much running on time or close to schedule. we're not seeing any problems there. there still is a disabled tractor-trailer out in roosevelt boulevard in northeast philadelphia. that's headed southbound taking out inner drive lanes approaching strahle street. here's the garden state parkway out in upper township around the cape may tolls. you can see a hazy camera lens right here. one car or so moving through, maybe you're heading down the shore or heading home from the shore, you'll have no problems doing so right now. katy? >> thanks, jessica. the road to rio is in its final stretch. we are three days away from the start of the 2016 olympic games in brazil. and the opening ceremony is set for this friday night. nbc 10 is the only place bringing you all of that sports action. >> olympic officials are insisting that rio de janeiro's waterways will be safe for athletes and visitors.

>> but a study found those waterways are as filthy as ever. the associate press commissioned a 16ati16-month test of guanaba bay. the study found some 1,400 athletes are at risk of getting sick in water competitions. the president of the international olympic committee appeared toisagree. >> you will have four tests a day. you see the measures being in place to remove the debris. it's all coming together. >> athletes said they were trying to protect themselves as best they could. some said the beaches are no dirtier than many others they visit ready. with the world coming to o rio, an increased police presence is in place around the olympic venues there. brazil is working with other countries, including the united states and france, to ensure safety and deal with the threat posed by global terrorism. nbc 10's jacqueline london is in rio right now for the games.

happening today in the philadelphia church sex abuse case, monsignor william lynn could move a step closer to freedom. >> lynn's lawyer plans to ask a judge to order the monsignor's release from prison. prosecutors are deciding whether or not to retry him. lynn has already served three years in prison for helping to protect priests accused of sex abuse. today, a veteran philadelphia firefighter will be laid to rest. this morning, a second viewing will be held for gabriel lee at deliverance evangelistic church. lee died last month at his firehouse. he was found in the basement unresponsive at ladder 12 in north philadelphia. he was a 17-year veteran of the philadelphia fire department. a funeral service will be held at the same church today at 11:00 a.m. the city of philadelphia is trying to reduce accidental shootings involving children by giving away gun locks. this is in response to a new law in the city that requires guns

to be locked when not in use. the giveaway will be at rhodes play ground at 75th and lansdowne avenue today from 6:00 to 8:30 and tomorrow at 32nd and cumberland. tonight is national night out. >> that's right. in montgomery county, officials got an early start for it. members of several police departments from across the county spent time hanging out with neighbors, kids, enjoying live entertainment and carnival rides. attorney general loretta lynch will help kick off the 33rd national night out in detroit. she's expected to discuss the need for strong positive relationships between communities and police. millions of people in all 50 states are expected to take part in tonight's festivities featuring block parties, cookouts and parades. happening today, north wildwood city council will decide if voters will get a chance to say if they want their sty's name changed. if the resolution is approved, the cape may county clerk will place a nonbinding question on the november ballot. last month, a group of residents

presented a petition to the mayor and city council asking that the name north wildwood be changed back to its original name, angle sea. now to a story from delaware county that we brought you as breaking news last night at 11:00. skyforce 10 was over a busted water main that closed the intersection of burmont and glendale road in havertown. the iodersection is expected to re-open by 8:00 this morning. i'm first alert traffic reporter jessica boyington with one last check on your morning drive. right now we're watching the schuylkill expressway, starting to see those delays into center city. yesterday around this time, we pretty much skipped over all morning rush. that's typically what a friday would look like or a monday would look like throughout the months of the summer but not tuesdays. again, this is around montgomery drive. we're seeing a 20-minute trip right now. we are already in the yellow. about a seven-minute increase there. that's the eastbound side heading into center city from that drive time from the blue
